The Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) has extended the I-9 compliance period of flexibility to April 30, 2022.
On March 20, 2020, the DHS and ICE announced flexibility in complying with requirements related to Form I-9 due to COVID-19. During the period of flexibility, employers can inspect documents used to complete Section 2 of the Form remotely (e.g., over video link, fax or email, etc.) and obtain, inspect and retain copies of the documents.
Because of ongoing precautions related to COVID-19, the DHS has extended this policy. The current extension continues to exempt employers from the physical inspection requirements for fully remote workers through April 30, 2022.
