Employer I-9 compliance requirements extended for remote workers

The Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) has extended the I-9 compliance period of flexibility to April 30, 2022

On March 20, 2020, the DHS and ICE announced flexibility in complying with requirements related to Form I-9 due to COVID-19. During the period of flexibility, employers can inspect documents used to complete Section 2 of the Form remotely (e.g., over video link, fax or email, etc.) and obtain, inspect and retain copies of the documents.

Because of ongoing precautions related to COVID-19, the DHS has extended this policy. The current extension continues to exempt employers from the physical inspection requirements for fully remote workers through April 30, 2022.  For more information about the requirements, visit the Insperity HR Resource Center on the Suspension of in-person I-9 inspection requirements.
